- Information on how to be eligible and prize details form part of these conditions. Entry into the Promotion is deemed acceptance of these terms and conditions.
- The promoter is Modern Geek (ABN: 33 538 869 343) located in Victoria, Australia.
- The Promotion will commence at 10:00am Friday September 15th 2010 and will continue until 5:00pm Sunday 26th July 2010 (“Promotion Period”).
Entry
- Entry is only open to those who have purchased & downloaded Our Secrets: Sharing App (“Application”) and has shared a secret within the Application during the promotion period (“Eligible Entrants”).
- To be eligible, Eligible Entrants must, during the Promotion Period, Share a secret within the Application and then share the secret at least once using the Applications built in Facebook sharing feature, Eligible Entrants could share it themselves or ask a friend to share the same secret through their own copy of the Application (the + sign when viewing a secret). Twitter shares do not count towards this competition, only Facebook shares. Eligible entrants may enter the competition as many times as they like.
Prize Selection
- Selection of the most creative secret from all the Eligible Entrants’ answers received that has also been shared through Facebook at least once (“Prize Selection”) will be conducted on 28th of September 2010 at 8:00pm. A representative of the Promoter will make the Prize Selection based on their discretionary estimation of the originality and creativity of all the Eligible Entrants’ answers.
- The winning Eligible Entrants selected will win an iTunes Gift card if they reside in Australia. If they do not reside in Australia the prize will be altered to a PayPal payment to that person. The winner in this case will have to provide their PayPal details.
- The Prize winner’s location and secret will be announced within the Application and on our website. The Winner will need to identify themselves by using our contact us form http://moderngeek.com.au/contact.aspx and supply their User ID, first name, last name & email address used to sign up to the Application originally. The promoter will be able to verify the winner based on their registration details.
General
- The total maximum prize value for the Promotion is $200 RRP (AUD)
- The Prize consists of two iTunes Gift cards valued at $100 each (“Prize”) delivered by email through the iTunes store.
- If the winner of the competition is not from Australia, the prize will be altered to a PayPal payment to that person of value $200 AUD. The winner in this case, will have to provide their PayPal details for payment of $200 AUD. Payment will be converted to the winners local currently by PayPal.
- All other costs associated with taking and using the Prize including insurance and warranties, are the responsibility of the winners.
- Prizes are not transferable, negotiable, refundable or exchangeable for cash.
- The Promoter takes no responsibility for any variation in the value of the Prize.
- If the Promoter is unable to provide the winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value.
- Entries which the Promoter considers to be incomplete, incorrect or incomprehensible, to contain defamatory or offensive content or to infringe third party intellectual rights are not eligible to win. The Promoter accepts no responsibility for late, lost or misdirected entries.
- Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry process in any way, or who does not properly comply with the entry process, will be ineligible to win.
- By accepting a Prize, the winner agrees to be contacted by the Promoter about the Promotion and participate in the Promoter’s publicity activities as reasonably requested, including having their secret & Country published as the winner within the Application and website. The winner’s identity will not be published. This is for use by the Promoter in future marketing and promotional activities without requiring further payment by the Promoter or further consent from the winner.
- The Promoter will not be held liable for any loss, damage or injury which results directly or indirectly from this Promotion, except that which cannot be excluded by law.
- In the case of disputes, the decision of the Promoter is final and binding and no correspondence will be entered into. All entries become the property of the Promoter. By entering this Promotion, entrants understand and agree that the Promoter may use and disclose the information provided to them on the terms and for the purposes (including marketing) set out in Modern Geek’s Privacy Statement, available here.
